RESERVATION REQUIREMENTS: A daily cleaning service can be provided at your request. Must inquire for fees. This request should be made at least one week in advance of your stay to ensure cleaners' availability.
POOL RULES: Pool heating is available for an additional fee for reservations staying. If additional pool heat is desired, the pool can be heated to 82-85 degrees for a fee of $150/night (for each night of your stay). Arrangements must be made within 48 hours of check-in. If, after checkout, it is evident that the pool heat has been tampered with, an additional fee of $150/night for each night of your stay will apply and be taken out of the security deposit. Spa is $50 a night.
SLIDE RULES: -Use the slide only in a feet first position -Ensure the splash area is clear before attempting to slide -Adult supervision required at all times -No standing, jumping or diving off any part of the slide -Do not climb the slide chute or other part of the slide except the ladder -Hold onto handrails at all times when using the ladder -No roughhousing or horseplay on slide -Only one rider at a time on the slide to prevent injury and entanglement upon impact to the water -Only one person allowed on the slide at the time with a maximum user of 275 LB (124 KG)
POOL/SPA: The property features a private pool and spa. Pools and spas are chemically serviced and cleaned regularly. All of our pools may be heated during the winter for your use and enjoyment upon request. All of our pools and spas have been properly cleaned in advance of your arrival. However, we experience winds in the desert that cause debris from Palm Trees and other materials to fall into the pool. Please advise the Property Manager if your pool is not clean, and we will make every effort to contact a pool cleaner, but please understand that
WE CANNOT GUARANTEE that the pool person will be able to return to the Property. In the event of any damages caused by tampering, the Guest shall be responsible for the cost of said damages.
NO GLASS NEAR or INSIDE POOL: Please bring solo cups for your beverages that come packaged in glass bottles or containers or use the plastic cup in the kitchen. Broken glass is a massive Liability as all of our guests are barefoot out near the pools. Please remember the wind has been known to blow pretty hard and blow your drinks over from time to time. If we find broken glass in the pool or near the pool, the renter will be charged up to $1000. The landlord makes his/her best efforts to keep the pool area clean of glass. If you find glass during your walkthrough of the house and backyard when you arrive, please notify the property owner or manager right away. You agree to waive any claim whatsoever against the owner for accidents or claims arising from swimming or being on the property.
CHECK-IN AND CHECK OUT: CHECK-IN TIME: 4:00 pm / CHECKOUT TIME: 10:00 am. The standard check-in time is 4:00 pm on every reservation. EARLY DEPARTURE/EVICTION POLICY: NO REFUNDS for early departure and/or eviction in any circumstance.
LATE DEPARTURE WITHOUT APPROVAL: Check-out is no later than 10 am on the day of departure. The entire 5-hour window between check-out and check-in is needed to adequately clean & prepare the home for the next guest. Out of respect for our housekeeping staff and newly arriving guests, we ask that you adhere to our arrival/departure times. If you have not vacated the premises by 10:00 am without prior approval for a later checkout time, you will be charged $200 per hour. Please understand this is not meant to be an inconvenience but to ensure that everyone has the same opportunity to enjoy their stay at this Property.
REQUEST LATE CHECK OUT: Please let your host know if you would like a late checkout or early check-in at least 48 hours before your arrival date. If you would like an early check-in of 1 pm an additional fee will be applied if we are able to accommodate. If you would like a late check-out up to 2 pm it will be an additional fee as well. If you would like an extended early or late checkout, let the host know and we will try our best to accommodate your request.
CLEANING: ****Cleaning Fee is DOUBLE the regular rate on music festival stays. DAMAGE DEPOSIT: A Damage Deposit of $3,000 REFUNDABLE DEPOSIT DUE FOR ALL COACHELLA AND STAGECOACH MUSIC FESTIVAL WEEKENDS* is required for all music festival stays and held by Airbnb. If there is no damage claim made at the end of your stay, Airbnb will return the deposit to you. Any damage claimed is at the sole discretion of the manager/owner and can be used to cover any fines incurred from our HOA during your stay, violations, missing or damaged items, any damage to the structure and or furniture inside and outside the home, and any repairs that need to be made as a result of your stay.
CANCELLATION POLICY/NO REFUND POLICY: There is a STRICT NO CANCELLATION/NO REFUND Policy for all dates booked in the month of April, COACHELLA AND STAGECOACH and all Major Holidays and festivals
NOISE POLICY: Please be respectful of all neighbors. Music shall not be played at a volume that carries across to the neighbors or disturbs their peace during the day. Noise travels easily in the mountains & we require that our guests be respectful of the full-time residents that live nearby. All Noise level must be REASONABLE AT ALL TIMES, BOTH INSIDE and OUTSIDE. You are more than welcome to play music inside the home at your level with the windows and doors shut. The city has a policy of not disturbing the quiet peace and enjoyment of our neighbors.
At 10 pm, "Quiet Time" is strictly enforced. There can be NO NOISE from 10 pm - 9 am. Outdoor music, loud screaming, drunkenness is not permitted after 10 pm. Fines starting at $500 and go up to $2500. The surrounding neighbors have access to a Complaint HOTLINE that they may call to file a complaint. The homeowner or the caretaker will be expected to respond to any complaint within 45 minutes or the Police will be called. City ordinances governing short-term rentals and noise control are strictly enforced. The Police and Code Enforcement Officers carry decibel meters and can monitor your sound levels. Failure to comply with any City ordinance may result in a citation, fine, or imprisonment. If we receive any complaints from the neighbors, we will attempt to contact you once to request that you reduce the level of noise. If the noise continues, we will ask you to vacate the property without any refund. No refund will be given if the guest is asked to leave the premises, even if the stay has not been completed
PARKING: Street parking is NOT permitted. 2 cars will fit in the garage, and 3 cars will fit in the driveway. Cars must be parked straight, not at an angle. Garage doors must be closed at all times other than loading and unloading. ** Please carpool accordingly. RV campers and/or tents on the premises or parking area are forbidden.
NO SMOKING POLICY: All our properties are non-smoking. There will be an extra cleaning fee added if this rule is broken up to $4000. Smoke detected inside the home by way of damage or odor will be fined, and such a fine will be taken out of the security/damage deposit.
PET(s) ALLOWED. Policy Pets are allowed for an additional fee of $300. If you are found out that you brought a pet, your stay will be terminated, and you will be asked to leave immediately. It is solely your responsibility to inform any guest(s) visiting you at this property or staying with you of the pet rules before they arrive. A refund for your stay will not be issued, and your deposit will not be refunded. If we find out after the fact that you had a pet during your stay you will be charged $400 per pet per day and other fees for any services the owner may have incurred because of bringing your pet. Service dogs are welcome; there will be an extra $350-dollar nonrefundable fee per service animal added to your reservation. You will also still be responsible for any damages the service animal does during the duration of the stay. This also goes for any guests you may have over that brings a service animal or unauthorized animal. Penal code 367.5 will be enforced.
HOUSE SUPPLIES: Your home will be stocked with an initial supply of trash bags, one paper towel roll, kitchen sponge, hand soap, dish soap, dishwasher pods, toilet paper, laundry pods.
OTHER ITEMS: The bathrooms are stocked with shampoo, conditioner, and liquid body wash. There are also fully equipped laundry rooms with washer, dryer, ironing board, and iron.
OUTSIDE GUESTS: If the primary guest or other occupants is/are expecting to host outside guests, such intentions must be clearly outlined upfront, and "guest fees" will apply. $100/per person per night for additional guests over 12 occupants.
TRASH: Bag all your trash and place it in the trash bins located on the side of the house near the garage. For your convenience, plastic trash bag liners are under the kitchen sink, pantry, or garage. Please do not put boxes in the bins as they take up too much space, instead break them down and place them inside. Trash pickup day is every Friday. Do NOT place bins at the end of the curb. We have a roll-out service that takes care of that.
SECURITY CAMERAS AND NOISE MONITORS: We have Ring cameras and noise monitors located on the exterior perimeter of the home only for liability and safety reasons. The noise monitors are to make sure we still continue to maintain a healthy relationship with our neighbors and the city ordinance of the 10 pm quiet time curfew is being abided by. Noise monitor is installed to ensure proper decibel levels are maintained. This device is like a smoke detector for loud excessive noise Please ask host if you have questions or concerns.
CHECK-IN AND CHECK OUT: WEATHER CONDITIONS - Guests are responsible for checking driving and weather forecasts in preparation for desert conditions at various times of the year, including, but not limited to, fog, wind, rain, etc. We do not refund due to weather conditions, road closures, driver's abilities, or vehicle limitations.
NATURAL HABITAT: Many different pests live and thrive in the Coachella Valley. The property has been professionally treated by a commercial pest control company with precise and complete preventative treatments in an effort to keep all the pests and bugs outside. Should you experience a pest control issue, rodent, or reptile issue please contact the host so they may attempt to eradicate the problem. We do not refund due to the presence of such insects, rodents, reptiles, or animals. Insects, rodents, reptiles, and animals are a normal part of the environment.
PERSONAL BELONGINGS: We are not responsible for any personal belongings left behind. If you leave something behind, we will not ship it to you unless you provide a label and mailing instructions and provide insurance on any item you want delivered back. We are not responsible for any item we ship to you that does not make it to its destination. There will be a $25.00 handling charge plus shipping costs for any found items returned at Guest's request. Manager shall not be held liable for the condition of said items. Any items not claimed for longer than 30 days, may be donated or sold.
THEFT OR DAMAGE - In the event of theft from or damage to the property caused during my stay, I authorize the owners upon inspection, notify me, and charge my credit card for the broken items in some cases over $5000. Due to the high turnover of tenants, the landlord reserves the right not to provide official invoices or quotes as the landlord gets verbal quotes for repairs. The renter allows the landlord to charge the renter the replacement value of any item. Respect the home and report any damages.
RULES OF CHECK-OUT:
DIRTY LINENS: Please gather all your towels and place them in the laundry and start a load if you can before leaving. We would appreciate it.
BEDS: Do not make the beds; leave all beds as is.
KITCHEN: Please do not leave dirty dishes in the sink or on the counter. Please rinse off the dishes, place them in the dishwasher, and start it. Any rinsed leftover dishes are to be left on the counter. All items should be cleaned and put away, including food and trash. If guests would like dishes and kitchen supplies done for them, prior arrangements can be made for a $100 fee.
DOORS/WINDOWS: Please make sure all doors and windows are locked before leaving. Please turn off all the lights.
THERMOSTAT: Please leave All A/C thermostats set to 85 before your checkout.
BBQ: Please clean the BBQ if used or an additional cleaning fee of $50 will be applied.Absolutely no charcoal grills allowed (the house has a natural gas BBQ)
FURNITURE: Any moved furniture must be returned to its original position.
TRASH: All trash from the house must be taken out to the garbage cans on the yard's side. *ADDITIONAL CLEANING: Additional cleaning fee may be in the amount of up to $500. Dishes or additional cleaning in the home is required other than the way it was found. Please pick up trash in the backyard as well; no confetti shall be used in the backyard. Also, professional cleaning may be required if the mess is out of the scope of typical needs.
FILM/VIDEO: The Property shall not be used as a location for amateur or professional film/video without the prior written consent and arrangement with the Owner and host.
NO EVENT/PARTY POLICY: Unless otherwise authorized in writing by Drew (Property Manager), no gatherings, loud celebrations, amplified music such as a DJ, large speakers, parties or other private events (collectively “events”) are to be held at the Property during your occupancy. Holding an event without receiving prior approval, permit or permission from the property Manager is considered abuse and breach of this Agreement and cause for immediate termination of Occupancy. In this event, guest will forfeit all monies, including security deposits.
SYSTEM(S) FAILURES: In the event the Property sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, cable, internet, pool, hot tub or other system or structural systems, neither the Property owner nor the Manager shall be liable to Guest for damages, and no refunds will be given for such failures. However, Manager will make an effort to promptly repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the Property to inspect and make such repairs.
MAINTENANCE AND REPORTING: Guest shall properly use, operate and safeguard the Property including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Guest shall immediately notify Property Manager of any problem, malfunction or damage. Guest shall pay for all repairs or replacements caused by Guest, excluding ordinary wear and tear. Guest shall pay for all damage to the Property as a result of failure to report a problem, malfunction or damage in a timely manner.
HOMEOWNER ASSOCIATION: If the Property is part of a Home Owner's Association (HOA) there will be additional rules and restrictions that all licensees and guests must abide by. A copy of the HOA rules should be in the Property, but if they are not, please let us know. Licensee agrees to maintain the Property in good order and appearance and abide by the HOA rules. "Quiet Time" in HOA developments is from 10 pm to 8 am. Loud parties on the Property that are in a HOA, or on HOA premises are prohibited and grounds for immediate eviction. Licensee agree there will be no disturbance, annoyance, endangerment or inconvenience of the neighbors. Due to the proximity of the houses, using vile or obscene language while outdoors is likely to disturb and annoy the neighbors. Parking vehicles on the street is against the HOA rules. RV campers and/or tents on the premises or parking area are forbidden. Garage doors are to be closed when not in use.
GOOD NEIGHBOR POLICY: You agree to abide by all rules and regulations set forth by local ordinances, which includes a “Good Neighbor Policy”. You are advised to keep in mind that vacation rental properties are located in quiet, private neighborhoods. Please respect our neighbors. Anyone found to be violating noise ordinances of the City or HOA will be subject to an initial $500 fine followed by a possible eviction in egregious circumstances. Guests will not be issues any refund for issues related to noise ordinance violations. Possible violations include, without limitation, sound amplification outdoors, over occupying parking areas, over occupying rental Property and failing to follow your Agreement with Manager HOA Rules and Regulations allow for 24-hour quiet enjoyment of homeowner's property. While strict quiet hours are enforced between 9:59PM-9:00AM and no outdoor music or noise is permitted during those times, noise violations and fines may be cited at any time of day or night. Parking is not permitted on the streets at any time. There are no parties allowed at this property. This Agreement and Guest's reservation is subject to the Governing Documents of the HOA and/or city where the property is located.
SPECIAL EVENTS, MUSIC FESTIVALS, AND HOLIDAY BOOKINGS: There is a strict no cancellation policy for all special events, holidays, and music festival timeframes. Festivals include but are not limited to Desert Trip, Coachella, and Stagecoach music festivals. Special events and music festivals that are canceled, postponed, or altered in any way, for any reason, do not qualify for any refund, alteration of the reservation or cancellation, including Acts of God, pandemics, epidemics or health outbreaks such as COVID-19. NO CREDIT WILL BE ISSUED IN THE CASE OF EARLY DEPARTURE OR CANCELLATION FOR ANY FESTIVAL BOOKING.
RELEASE & WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT. You understand that you accept full responsibility for any bodily injury arising from swimming and all accidents that may happen on the property and hold the owner harmless. You understand there are potential dangers with swimming and may present a danger to adults who consume medication, alcohol, or drugs and children who are not carefully supervised. You agree to be fully and solely responsible for any accidents you may incur. You understand the risks discussed above and agree that you will assume all responsibility for yourself and the consequences of those in your party. You agree to waive any claim whatsoever against the owner for accidents or claims arising from swimming or being on the property. Renter shall indemnify, defend and hold harmless the property owner, its respective affiliates and partners from and against all demands, suits, judgments, settlements, claims, damages to persons and/or property, fines, liens, losses, and other liabilities, including attorneys' fees arising out of or in any way related to your stay in our property and its surrounding land including claims for loss or damage to any property or for death or injury to any individual. All the homes are privately owned; the owners are not responsible for any accidents, injuries, or illnesses that occur while on the premises or facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to the property. In compliance with the City of Indio ORDINANCE NO. 1665 section 37.011 OPERATIONAL REQUIREMENTS AND PERFORMANCE STANDARDS ESTABLISHED; It is required that the primary overnight and daytime occupant of the short -term vacation rental to be an adult 25 years of age or older. OCCUPANCY: If the occupancy does not match the Airbnb Reservation we need to update it. If we find the property has additional guests over your reservation during your stay then an additional fee of $100/per person per night will be applied. This is an Airbnb requirement for insurance and safety concerns if the home is overcapacity. We are committed to Rent Responsibly standards. This means we follow best-in-class guidelines to ensure you have a peaceful, safe, and memorable stay with us. We use smart home technology to improve your experience. NoiseAware is a smart home device that measures volume levels (does not record audio) primarily around the pool which allows us to respond to noise nuisances without disrupting your stay. NoiseAware is 100% privacy compliant and is required on this property. If you have any questions, please ask. We are committed to your comfort so please let us know if we can do anything during your stay to make it more enjoyable."
WAIVO SECURITY DEPOSIT WAIVER
I. AGREEMENT On behalf of Luxury Desert Escape, the party authorized to rent the vacation rental property and the owner of the vacation rental property, Waivo has assumed the responsibility for damages as outlined below and waives Your security deposit up to $5,000, the waiver limit purchased by You, the renter, for your stay at the vacation rental property.
Waivo is hereby responsible for theft or direct damage to real or personal property of the vacation rental property as a result of Your acts or omissions. Waivo will pay the lesser of the cost of repairs or the cost to replace the property up to $5,000. This waiver does not negate your responsibilities as a renter for items outside of Waivo’s responsibilities. This is not an agreement to provide insurance. You are buying a waiver of the security deposit otherwise due as part of Your vacation rental property lease agreement.
II. EXCLUSIONS This Security Deposit Waiver will not pay for damages or theft resulting from: 1. Acts of god 2. Prior damage, or normal wear and tear 3. Theft without a valid police report 4. Loss of use of the vacation rental property 5. Rodent, termite, infestation, or wild animal 6. Damage to a motorized vehicle 7. Fine art or collectibles This Waiver will not pay for damage or theft of property owned by You. This Waiver will not pay for costs associated with odor, debris removal, mechanical breakdown.
III. CONDITIONS Waivo has the sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the waiver, and shall exercise that authority in a reasonable manner. Waivo reserves the right to determine if damage is eligible for reimbursement at actual cash value. This Waiver will pay for excessive cleaning, as a direct result of damage, over and above the normal cleaning fee. A stain or spillage is considered damage. This Waiver is only effective for a one-time single continuous stay for which You purchased the Waiver. It takes effect when You occupy the vacation rental property and terminates when You depart the same vacation rental property. This Waiver is only effective if any theft or damage is reported to Waivo by You, the property manager, the online travel agent or the owner of the vacation rental property within 3 days of Your departure from the vacation rental property. Waivo will not respond to damage or theft under $50 US dollars. If there is a dispute related to these terms, mediation is required before any party may file litigation. In the event of litigation, all parties waive the right to a jury trial.
IV. DEFINITIONS You, or Your, is the renter of the vacation rental property and includes the renter’s spouse, children and any other person the renter invited on to the vacation rental property during your stay at the vacation rental property. ***Please be mindful of our neighbors during your stay. Our property's quiet hours are in place to ensure that everyone can enjoy a peaceful night's sleep. We care a lot about maintaining good relationships with our community, so we appreciate you following our "house rules" during your stay.

If we find broken glass in the pool or near the pool, the renter will be charged up to $1000. The landlord makes his/her best efforts to keep the pool area clean of glass. If you find glass during your walkthrough of the house and backyard when you arrive, please notify the property owner or manager right away. You agree to waive any claim whatsoever against the owner for accidents or claims arising from swimming or being on the property.
CHECK-IN AND CHECK OUT: CHECK-IN TIME: 4:00 pm / CHECKOUT TIME: 10:00 am. The standard check-in time is 4:00 pm on every reservation. EARLY DEPARTURE/EVICTION POLICY: NO REFUNDS for early departure and/or eviction in any circumstance.
LATE DEPARTURE WITHOUT APPROVAL: Check-out is no later than 10 am on the day of departure. The entire 5-hour window between check-out and check-in is needed to adequately clean & prepare the home for the next guest. Out of respect for our housekeeping staff and newly arriving guests, we ask that you adhere to our arrival/departure times. If you have not vacated the premises by 10:00 am without prior approval for a later checkout time, you will be charged $200 per hour. Please understand this is not meant to be an inconvenience but to ensure that everyone has the same opportunity to enjoy their stay at this Property.
REQUEST LATE CHECK OUT: Please let your host know if you would like a late checkout or early check-in at least 48 hours before your arrival date. If you would like an early check-in of 1 pm an additional fee will be applied if we are able to accommodate. If you would like a late check-out up to 2 pm it will be an additional fee as well. If you would like an extended early or late checkout, let the host know and we will try our best to accommodate your request.
CLEANING: ****Cleaning Fee is DOUBLE the regular rate on music festival stays. DAMAGE DEPOSIT: A Damage Deposit of $3,000 REFUNDABLE DEPOSIT DUE FOR ALL COACHELLA AND STAGECOACH MUSIC FESTIVAL WEEKENDS* is required for all music festival stays and held by Airbnb. If there is no damage claim made at the end of your stay, Airbnb will return the deposit to you. Any damage claimed is at the sole discretion of the manager/owner and can be used to cover any fines incurred from our HOA during your stay, violations, missing or damaged items, any damage to the structure and or furniture inside and outside the home, and any repairs that need to be made as a result of your stay.
CANCELLATION POLICY/NO REFUND POLICY: There is a STRICT NO CANCELLATION/NO REFUND Policy for all dates booked in the month of April, COACHELLA AND STAGECOACH and all Major Holidays and festivals
NOISE POLICY: Please be respectful of all neighbors. Music shall not be played at a volume that carries across to the neighbors or disturbs their peace during the day. Noise travels easily in the mountains & we require that our guests be respectful of the full-time residents that live nearby. All Noise level must be REASONABLE AT ALL TIMES, BOTH INSIDE and OUTSIDE. You are more than welcome to play music inside the home at your level with the windows and doors shut. The city has a policy of not disturbing the quiet peace and enjoyment of our neighbors.
At 10 pm, "Quiet Time" is strictly enforced. There can be NO NOISE from 10 pm - 9 am. Outdoor music, loud screaming, drunkenness is not permitted after 10 pm. Fines starting at $500 and go up to $2500. The surrounding neighbors have access to a Complaint HOTLINE that they may call to file a complaint. The homeowner or the caretaker will be expected to respond to any complaint within 45 minutes or the Police will be called. City ordinances governing short-term rentals and noise control are strictly enforced. The Police and Code Enforcement Officers carry decibel meters and can monitor your sound levels. Failure to comply with any City ordinance may result in a citation, fine, or imprisonment. If we receive any complaints from the neighbors, we will attempt to contact you once to request that you reduce the level of noise. If the noise continues, we will ask you to vacate the property without any refund. No refund will be given if the guest is asked to leave the premises, even if the stay has not been completed
PARKING: Street parking is NOT permitted. 2 cars will fit in the garage, and 3 cars will fit in the driveway. Cars must be parked straight, not at an angle. Garage doors must be closed at all times other than loading and unloading. ** Please carpool accordingly. RV campers and/or tents on the premises or parking area are forbidden.
NO SMOKING POLICY: All our properties are non-smoking. There will be an extra cleaning fee added if this rule is broken up to $4000. Smoke detected inside the home by way of damage or odor will be fined, and such a fine will be taken out of the security/damage deposit.
PET(s) ALLOWED. Policy Pets are allowed for an additional fee of $300. If you are found out that you brought a pet, your stay will be terminated, and you will be asked to leave immediately. It is solely your responsibility to inform any guest(s) visiting you at this property or staying with you of the pet rules before they arrive. A refund for your stay will not be issued, and your deposit will not be refunded. If we find out after the fact that you had a pet during your stay you will be charged $400 per pet per day and other fees for any services the owner may have incurred because of bringing your pet. Service dogs are welcome; there will be an extra $350-dollar nonrefundable fee per service animal added to your reservation. You will also still be responsible for any damages the service animal does during the duration of the stay. This also goes for any guests you may have over that brings a service animal or unauthorized animal. Penal code 367.5 will be enforced.
HOUSE SUPPLIES: Your home will be stocked with an initial supply of trash bags, one paper towel roll, kitchen sponge, hand soap, dish soap, dishwasher pods, toilet paper, laundry pods.
OTHER ITEMS: The bathrooms are stocked with shampoo, conditioner, and liquid body wash. There are also fully equipped laundry rooms with washer, dryer, ironing board, and iron.
OUTSIDE GUESTS: If the primary guest or other occupants is/are expecting to host outside guests, such intentions must be clearly outlined upfront, and "guest fees" will apply. $100/per person per night for additional guests over 12 occupants.
TRASH: Bag all your trash and place it in the trash bins located on the side of the house near the garage. For your convenience, plastic trash bag liners are under the kitchen sink, pantry, or garage. Please do not put boxes in the bins as they take up too much space, instead break them down and place them inside. Trash pickup day is every Friday. Do NOT place bins at the end of the curb. We have a roll-out service that takes care of that.
SECURITY CAMERAS AND NOISE MONITORS: We have Ring cameras and noise monitors located on the exterior perimeter of the home only for liability and safety reasons. The noise monitors are to make sure we still continue to maintain a healthy relationship with our neighbors and the city ordinance of the 10 pm quiet time curfew is being abided by. Noise monitor is installed to ensure proper decibel levels are maintained. This device is like a smoke detector for loud excessive noise Please ask host if you have questions or concerns.
CHECK-IN AND CHECK OUT: WEATHER CONDITIONS - Guests are responsible for checking driving and weather forecasts in preparation for desert conditions at various times of the year, including, but not limited to, fog, wind, rain, etc. We do not refund due to weather conditions, road closures, driver's abilities, or vehicle limitations.
NATURAL HABITAT: Many different pests live and thrive in the Coachella Valley. The property has been professionally treated by a commercial pest control company with precise and complete preventative treatments in an effort to keep all the pests and bugs outside. Should you experience a pest control issue, rodent, or reptile issue please contact the host so they may attempt to eradicate the problem. We do not refund due to the presence of such insects, rodents, reptiles, or animals. Insects, rodents, reptiles, and animals are a normal part of the environment.
PERSONAL BELONGINGS: We are not responsible for any personal belongings left behind. If you leave something behind, we will not ship it to you unless you provide a label and mailing instructions and provide insurance on any item you want delivered back. We are not responsible for any item we ship to you that does not make it to its destination. There will be a $25.00 handling charge plus shipping costs for any found items returned at Guest's request. Manager shall not be held liable for the condition of said items. Any items not claimed for longer than 30 days, may be donated or sold.
THEFT OR DAMAGE - In the event of theft from or damage to the property caused during my stay, I authorize the owners upon inspection, notify me, and charge my credit card for the broken items in some cases over $5000. Due to the high turnover of tenants, the landlord reserves the right not to provide official invoices or quotes as the landlord gets verbal quotes for repairs. The renter allows the landlord to charge the renter the replacement value of any item. Respect the home and report any damages.
RULES OF CHECK-OUT:
DIRTY LINENS: Please gather all your towels and place them in the laundry and start a load if you can before leaving. We would appreciate it.
BEDS: Do not make the beds; leave all beds as is.
KITCHEN: Please do not leave dirty dishes in the sink or on the counter. Please rinse off the dishes, place them in the dishwasher, and start it. Any rinsed leftover dishes are to be left on the counter. All items should be cleaned and put away, including food and trash. If guests would like dishes and kitchen supplies done for them, prior arrangements can be made for a $100 fee.
DOORS/WINDOWS: Please make sure all doors and windows are locked before leaving. Please turn off all the lights.
THERMOSTAT: Please leave All A/C thermostats set to 85 before your checkout.
BBQ: Please clean the BBQ if used or an additional cleaning fee of $50 will be applied.Absolutely no charcoal grills allowed (the house has a natural gas BBQ)
FURNITURE: Any moved furniture must be returned to its original position.
TRASH: All trash from the house must be taken out to the garbage cans on the yard's side. *ADDITIONAL CLEANING: Additional cleaning fee may be in the amount of up to $500. Dishes or additional cleaning in the home is required other than the way it was found. Please pick up trash in the backyard as well; no confetti shall be used in the backyard. Also, professional cleaning may be required if the mess is out of the scope of typical needs.
FILM/VIDEO: The Property shall not be used as a location for amateur or professional film/video without the prior written consent and arrangement with the Owner and host.
NO EVENT/PARTY POLICY: Unless otherwise authorized in writing by Drew (Property Manager), no gatherings, loud celebrations, amplified music such as a DJ, large speakers, parties or other private events (collectively “events”) are to be held at the Property during your occupancy. Holding an event without receiving prior approval, permit or permission from the property Manager is considered abuse and breach of this Agreement and cause for immediate termination of Occupancy. In this event, guest will forfeit all monies, including security deposits.
SYSTEM(S) FAILURES: In the event the Property sustains a failure of a system, including but not limited to water, sewer, septic, electrical, gas, plumbing, mechanical, appliances, heat pump, ventilating, cable, internet, pool, hot tub or other system or structural systems, neither the Property owner nor the Manager shall be liable to Guest for damages, and no refunds will be given for such failures. However, Manager will make an effort to promptly repair or replace the failed system or equipment, and in such event, Guest agrees to permit Manager or its service provider to have reasonable access to the Property to inspect and make such repairs.
MAINTENANCE AND REPORTING: Guest shall properly use, operate and safeguard the Property including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Guest shall immediately notify Property Manager of any problem, malfunction or damage. Guest shall pay for all repairs or replacements caused by Guest, excluding ordinary wear and tear. Guest shall pay for all damage to the Property as a result of failure to report a problem, malfunction or damage in a timely manner.
HOMEOWNER ASSOCIATION: If the Property is part of a Home Owner's Association (HOA) there will be additional rules and restrictions that all licensees and guests must abide by. A copy of the HOA rules should be in the Property, but if they are not, please let us know. Licensee agrees to maintain the Property in good order and appearance and abide by the HOA rules. "Quiet Time" in HOA developments is from 10 pm to 8 am. Loud parties on the Property that are in a HOA, or on HOA premises are prohibited and grounds for immediate eviction. Licensee agree there will be no disturbance, annoyance, endangerment or inconvenience of the neighbors. Due to the proximity of the houses, using vile or obscene language while outdoors is likely to disturb and annoy the neighbors. Parking vehicles on the street is against the HOA rules. RV campers and/or tents on the premises or parking area are forbidden. Garage doors are to be closed when not in use.
GOOD NEIGHBOR POLICY: You agree to abide by all rules and regulations set forth by local ordinances, which includes a “Good Neighbor Policy”. You are advised to keep in mind that vacation rental properties are located in quiet, private neighborhoods. Please respect our neighbors. Anyone found to be violating noise ordinances of the City or HOA will be subject to an initial $500 fine followed by a possible eviction in egregious circumstances. Guests will not be issues any refund for issues related to noise ordinance violations. Possible violations include, without limitation, sound amplification outdoors, over occupying parking areas, over occupying rental Property and failing to follow your Agreement with Manager HOA Rules and Regulations allow for 24-hour quiet enjoyment of homeowner's property. While strict quiet hours are enforced between 9:59PM-9:00AM and no outdoor music or noise is permitted during those times, noise violations and fines may be cited at any time of day or night. Parking is not permitted on the streets at any time. There are no parties allowed at this property. This Agreement and Guest's reservation is subject to the Governing Documents of the HOA and/or city where the property is located.
SPECIAL EVENTS, MUSIC FESTIVALS, AND HOLIDAY BOOKINGS: There is a strict no cancellation policy for all special events, holidays, and music festival timeframes. Festivals include but are not limited to Desert Trip, Coachella, and Stagecoach music festivals. Special events and music festivals that are canceled, postponed, or altered in any way, for any reason, do not qualify for any refund, alteration of the reservation or cancellation, including Acts of God, pandemics, epidemics or health outbreaks such as COVID-19. NO CREDIT WILL BE ISSUED IN THE CASE OF EARLY DEPARTURE OR CANCELLATION FOR ANY FESTIVAL BOOKING.
RELEASE & WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT. You understand that you accept full responsibility for any bodily injury arising from swimming and all accidents that may happen on the property and hold the owner harmless. You understand there are potential dangers with swimming and may present a danger to adults who consume medication, alcohol, or drugs and children who are not carefully supervised. You agree to be fully and solely responsible for any accidents you may incur. You understand the risks discussed above and agree that you will assume all responsibility for yourself and the consequences of those in your party. You agree to waive any claim whatsoever against the owner for accidents or claims arising from swimming or being on the property. Renter shall indemnify, defend and hold harmless the property owner, its respective affiliates and partners from and against all demands, suits, judgments, settlements, claims, damages to persons and/or property, fines, liens, losses, and other liabilities, including attorneys' fees arising out of or in any way related to your stay in our property and its surrounding land including claims for loss or damage to any property or for death or injury to any individual. All the homes are privately owned; the owners are not responsible for any accidents, injuries, or illnesses that occur while on the premises or facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to the property. In compliance with the City of Indio ORDINANCE NO. 1665 section 37.011 OPERATIONAL REQUIREMENTS AND PERFORMANCE STANDARDS ESTABLISHED; It is required that the primary overnight and daytime occupant of the short -term vacation rental to be an adult 25 years of age or older. OCCUPANCY: If the occupancy does not match the Airbnb Reservation we need to update it. If we find the property has additional guests over your reservation during your stay then an additional fee of $100/per person per night will be applied. This is an Airbnb requirement for insurance and safety concerns if the home is overcapacity. We are committed to Rent Responsibly standards. This means we follow best-in-class guidelines to ensure you have a peaceful, safe, and memorable stay with us. We use smart home technology to improve your experience. NoiseAware is a smart home device that measures volume levels (does not record audio) primarily around the pool which allows us to respond to noise nuisances without disrupting your stay. NoiseAware is 100% privacy compliant and is required on this property. If you have any questions, please ask. WAIVO SECURITY DEPOSIT WAIVER
I. AGREEMENT On behalf of Luxury Desert Escape, the party authorized to rent the vacation rental property and the owner of the vacation rental property, Waivo has assumed the responsibility for damages as outlined below and waives Your security deposit up to $5,000, the waiver limit purchased by You, the renter, for your stay at the vacation rental property.
Waivo is hereby responsible for theft or direct damage to real or personal property of the vacation rental property as a result of Your acts or omissions. Waivo will pay the lesser of the cost of repairs or the cost to replace the property up to $5,000. This waiver does not negate your responsibilities as a renter for items outside of Waivo’s responsibilities. This is not an agreement to provide insurance. You are buying a waiver of the security deposit otherwise due as part of Your vacation rental property lease agreement.
II. EXCLUSIONS This Security Deposit Waiver will not pay for damages or theft resulting from: 1. Acts of god 2. Prior damage, or normal wear and tear 3. Theft without a valid police report 4. Loss of use of the vacation rental property 5. Rodent, termite, infestation, or wild animal 6. Damage to a motorized vehicle 7. Fine art or collectibles This Waiver will not pay for damage or theft of property owned by You. This Waiver will not pay for costs associated with odor, debris removal, mechanical breakdown.
III. CONDITIONS Waivo has the sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the waiver, and shall exercise that authority in a reasonable manner. Waivo reserves the right to determine if damage is eligible for reimbursement at actual cash value. This Waiver will pay for excessive cleaning, as a direct result of damage, over and above the normal cleaning fee. A stain or spillage is considered damage. This Waiver is only effective for a one-time single continuous stay for which You purchased the Waiver. It takes effect when You occupy the vacation rental property and terminates when You depart the same vacation rental property. This Waiver is only effective if any theft or damage is reported to Waivo by You, the property manager, the online travel agent or the owner of the vacation rental property within 3 days of Your departure from the vacation rental property. Waivo will not respond to damage or theft under $50 US dollars. If there is a dispute related to these terms, mediation is required before any party may file litigation. In the event of litigation, all parties waive the right to a jury trial.
IV. DEFINITIONS You, or Your, is the renter of the vacation rental property and includes the renter’s spouse, children and any other person the renter invited on to the vacation rental property during your stay at the vacation rental property. ***Please be mindful of our neighbors during your stay. Our property's quiet hours are in place to ensure that everyone can enjoy a peaceful night's sleep. We care a lot about maintaining good relationships with our community, so we appreciate you following our "house rules" during your stay.
